Summary for Patent: 5,424,412
Title: Enhanced expression in plants
Abstract:This invention provides HSP70 introns that when present in a non-translated leader of a chimeric gene enhance expression in plants.
Inventor(s): Brown; Sherri M. (Chesterfield, MO), Santino; Colleen G. (St. Louis, MO)
Assignee: Monsanto Company (St. Louis, MO)
Application Number:08/181,364
Patent Claims:1. A recombinant, double stranded DNA construct comprising in sequence:

a promoter that functions in plant cells to cause the production of an RNA sequence;

a non-translated leader comprising an intron sequence selected from the group consisting of SEQ ID NO:1, SEQ ID NO:2 and SEQ ID NO:3;

a structural DNA sequence that causes the production of an RNA sequence that encodes a protein; and

a 3' non-translated sequence that functions in plant cells to cause the addition of polyadenylated nucleotides to the 3' end of the RNA sequence, the intron being heterologous with respect to the promoter.

2. The DNA construct of claim 1 in which the intron is SEQ ID NO:1.

3. The DNA construct of claim 1 in which the intron is SEQ ID NO:2.

4. The DNA construct of claim 1 in which the intron is SEQ ID NO:3.

5. The DNA construct of claim 2 wherein said promoter is a plant DNA virus promoter.

6. The DNA construct of claim 5 wherein said promoter is selected from the group consisting of a CaMV35S promoter and a FMV promoter.

7. The DNA construct of claim 6 wherein the structural DNA sequence encodes for a EPSP synthase.

8. The DNA construct of claim 6 wherein the structural DNA sequence encodes for a CP4 protein.

9. The DNA construct of claim 6 wherein the structural DNA sequence encodes for ACC-deaminase.

10. The DNA construct of claim 6 wherein the structural DNA sequence encodes for a B.t. crystal toxin protein.

11. The DNA construct of claim 6 wherein the structural DNA sequence encodes glgC16 protein.

12. A synthetic DNA sequence comprising the nucleotides of SEQ ID NO:1.

13. A truncated DNA sequence comprising the nucleotides of SEQ ID NO:2.

14. A truncated DNA sequence comprising the nucleotides of SEQ ID NO:3.
