Title:Elastomeric functional biodegradable copolyester amides and copolyester urethanes
Abstract: The invention provides elastomeric copolyester amides, elastomeric copolyester urethanes, and methods for making the same. The polymers are based on .alpha.-amino acids and possess physical, chemical and biodegradation properties that render them suitable for use in the human body. The polymers are useful as carriers of drugs or other bioactive substances. The polymers can also be linked, intermixed, or a combination thereof, to one or more drugs. Additionally, the polymers can be used to coat stents, for example, to suppress restenosis. Furthermore, the biodegradation of the copolyester amides and copolyester urethanes allows for the delivery of essential .alpha.-amino acids to sites in the body, for example, to facilitate wound repair of injured tissues.

Patent Claims:1. A polymer of formula (VII): ##STR00036## wherein m is about 0.1 to about 0.9; p is about 0.9 to about 0.1; n is about 50 to about 150; each R.sup.1 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.8, or (CH.sub.2).sub.12; each R.sup.2 is independently hydrogen, or (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl; each R.sup.3 is independently hydrogen, (C.sub.1-C.sub.6)alkyl, (C.sub.2-C.sub.6)alkenyl, or (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl; and each R.sup.4 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.6, (CH.sub.2).sub.8, or (CH.sub.2).sub.12.

2. The polymer of claim 1 wherein each R.sup.1 is (CH.sub.2).sub.4.

3. The polymer of claim 1 wherein each R.sup.1 is (CH.sub.2).sub.8.

4. The polymer of claim 1 wherein each R.sup.1 is (CH.sub.2).sub.12.

5. The polymer of claim 1 wherein each R.sup.4 is (CH.sub.2).sub.4.

6. The polymer of claim 1 wherein each R.sup.4 is (CH.sub.2).sub.6.

7. The polymer of claim 1 wherein each R.sup.4 is (CH.sub.2).sub.8.

8. The polymer of claim 1 wherein each R.sup.4 is (CH.sub.2).sub.12.

9. A polymer comprising one or more subunits of the formula (I): ##STR00037## wherein each R.sup.1 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.8, or (CH.sub.2).sub.12; and each R.sup.2 is independently hydrogen, or (C.sub.6-C.sub.10 )aryl(C.sub.1-C.sub.6)alkyl; and one or more subunits of the formula (II): ##STR00038## wherein each R.sup.1 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.8, or (CH.sub.2).sub.12; each R.sup.3 is independently hydrogen, (C.sub.1-C.sub.6)alkyl, (C.sub.2-C.sub.6)alkenyl, or (C.sub.6-C.sub.10 )aryl(C.sub.1 -C.sub.6)alkyl; and each R.sup.4 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.6, (CH.sub.2).sub.8, or (CH.sub.2).sub.12.

10. The polymer of claim 9 wherein each R.sup.1 is (CH.sub.2).sub.4.

11. The polymer of claim 9 wherein each R.sup.1 is (CH.sub.2).sub.8.

12. The polymer of claim 9 wherein each R.sup.1 is (CH.sub.2).sub.12.

13. The polymer of claim 9 wherein each R.sup.4 is (CH.sub.2).sub.4.

14. The polymer of claim 9 wherein each R.sup.4 is (CH.sub.2).sub.6.

15. The polymer of claim 9 wherein each R.sup.4 is (CH.sub.2).sub.8.

16. The polymer of claim 9 wherein each R.sup.4 is (CH.sub.2).sub.12.

17. A polymer formed from an amount of one or more compounds of formula (III): ##STR00039## wherein each R.sup.3 is independently hydrogen, (.sub.1-C.sub.6)alkyl, (C.sub.2-C.sub.6)alkenyl, or (C.sub.6-C.sub.10)aryl(C.sub.1 -C.sub.6)alkyl; and R.sup.4 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.6, (CH.sub.2).sub.8, or (CH.sub.2).sub.12; or a suitable salt thereof an amount of one or more compounds of formula (IV): ##STR00040## wherein R.sup.2 is independently hydrogen, or (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl; or a suitable salt thereof; and an amount of one or more compounds of formula (V): ##STR00041## wherein R.sup.1 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.8, or (CH.sub.2).sub.12; and each R.sup.5 is independently (C.sub.6-C.sub.10)aryl optionally substituted with one or more nitro, cyano, halo, trifluoromethyl, or trifluoromethoxy.

18. The polymer of claim 17 wherein R.sup.1 is (CH.sub.2).sub.4.

19. The polymer of claim 17 wherein R.sup.1 is (CH.sub.2).sub.8.

20. The polymer of claim 17 wherein R.sup.1 is (CH.sub.2).sub.12.

21. The polymer of claim 17 wherein R.sup.4 is (CH.sub.2).sub.4.

22. The polymer of claim 17 wherein R.sup.4 is (CH.sub.2).sub.6.

23. The polymer of claim 17 wherein R.sup.4 is (CH.sub.2).sub.8.

24. The polymer of claim 17 wherein R.sup.4 is (CH.sub.2).sub.12.

25. A polymer comprising one or more subunits of the formula (VIII): ##STR00042## wherein each R.sup.3 is independently hydrogen, (C.sub.1-C.sub.6)alkyl, (C.sub.2-C.sub.6)alkenyl, or (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl; R.sup.4 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.6, (CH.sub.2).sub.8, or (CH.sub.2).sub.12; and R.sup.6 is independently (C.sub.2-C.sub.20)alkyl or (C.sub.2-C.sub.8)alkyloxy(C.sub.2-C.sub.20)alkyl; and one or more subunits of the formula (IX): ##STR00043## wherein R.sup.2 is independently hydrogen, or (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl; and R.sup.6 is independently (C.sub.2-C.sub.20)alkyl or (C.sub.2-C.sub.8)alkyloxy(C.sub.2-C.sub.20)alkyl;.

26. The polymer of claim 25 wherein R.sup.4 is (CH.sub.2).sub.4.

27. The polymer of claim 25 wherein R.sup.4 is (CH.sub.2).sub.6.

28. The polymer of claim 25 wherein R.sup.4 is (CH.sub.2).sub.8.

29. The polymer of claim 25 wherein R.sup.4 is (CH.sub.2).sub.12.

30. The polymer of claim 25 wherein R.sup.6 of formula (VIII) is (CH.sub.2)--.sub.3.

31. The polymer of claim 25 wherein R.sup.6 of formula (VIII) is (CH.sub.2).sub.2--O--(CH.sub.2).sub.2.

32. The polymer of claim 25 wherein R.sup.6 of formula (IX) is (CH.sub.2).sub.3.

33. The polymer of claim 25 wherein R.sup.6 of formula (IX) is (CH.sub.2).sub.2--O--(CH.sub.2).sub.2.

34. A polymer of formula (VII): ##STR00044## wherein m is about 0.1 to about 0.9; p is about 0.9 to about 0.1; n is about 50 to about 150; each R.sup.1 is independently (C.sub.2-C.sub.20)alkyl; each R.sup.2 is independently hydrogen, (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl, a drug, or -L-drug wherein L is a linker; each R.sup.3 is independently hydrogen, (C.sub.1-C.sub.6)alkyl, (C.sub.2-C.sub.6)alkenyl, or (C.sub.6-C.sub.10)aryl(C.sub.1-C.sub.6)alkyl; and each R.sup.4 is independently (CH.sub.2).sub.4, (CH.sub.2).sub.6, (CH.sub.2).sub.8, or (CH.sub.2).sub.12.

35. The polymer of claim 34 wherein one or more R.sup.2 are -L-drug.

36. The polymer of claim 35 wherein the linker separates the polymer and a residue of the drug by about 5 angstroms to about 200 angstroms, inclusive, in length.

37. The polymer of claim 35 wherein the linker comprises an amide, ester, ether, amino, ketone, thioether, sulfinyl, sulfonyl, or a disulfide linkage.

38. The polymer of claim 35 wherein the linker is a divalent radical of the formula W-A-Q; wherein A is (C.sub.1-C.sub.24)alkyl, (C.sub.2-C.sub.24)alkenyl, (C.sub.2-C.sub.24)alkynyl, (C.sub.3-C.sub.8)cycloalkyl, or (C.sub.6-C.sub.10)aryl; and W and Q are each independently --N(R)C(.dbd.O)--, --C(.dbd.O)N(R)--, --OC(.dbd.O)--, --C(.dbd.O)O--, --O--, --S--, --S(O)--, --S(O).sub.2--, --S--S--, --N(R)--, --OC.dbd.O)--, or a direct bond, wherein each R is independently H or (C.sub.1-C.sub.6)alkyl.

39. The polymer of claim 35 wherein the linker is a 1, .omega.-divalent radical formed from a peptide or an amino acid.

40. The polymer of claim 39 wherein the peptide comprises 2 to about 25 amino acids.

41. The polymer of claim 39 wherein the peptide is poly-L-lysine, poly-L-glutamic acid, poly-L-aspartic acid, poly-L-histidine, poly-L-omithine, poly-L-serine, poly-L-threonine, poly-L-tyrosine, poly-L-leucine, poly-L-lysine-L-phenylalanine, poly-L-arginine, or poly-L-lysine-L-tyrosine.

42. The polymer of claim 34 wherein the drug comprises a polynucleotide, polypeptide, oligonucleotide, gene therapy agent, nucleotide analog, nucleoside analog, polynucleic acid decoy, therapeutic antibody, abciximab, anti-inflammatory agent, blood modifier, anti-platelet agent, anti-coagulation agent, immune suppressive agent, anti-neoplastic agent, anti-cancer agent, anti-cell proliferation agent, or nitric oxide releasing agent.
